I. Acceptance of Terms

By accessing or using MONOLITHOS ("The Monolith System," "The Service"), you agree to be bound by these Terms of Service ("The Shield").

If you do not agree, do not use the Service. It's that simple.

These terms constitute a legally binding agreement between you ("User," "You") and Monolithos LLC ("Company," "We," "Us").

II. Definitions

The Monolith System	The complete MONOLITHOS software package, including all modules across desktop and mobile platforms
The Synapse	Our compute subscription service providing AI processing capabilities
Platform	MONOLITHOS desktop (macOS / Windows) and mobile (iOS) applications
API Key	Your unique authentication credential for accessing our backend services
Vault	Your local Markdown vault containing your notes and files

III. The Service

3.1 What We Provide

MONOLITHOS is a Life Operating System—a suite of AI-powered tools designed to enhance your thinking, not replace it.

We provide:

Software (The Monolith System)
AI compute infrastructure (The Synapse)
Technical support via designated channels

3.2 What We Do NOT Provide

We are not providing:

Financial advice
Legal advice
Medical advice
Investment recommendations
Business consulting
Life coaching
Therapy or mental health services

MONOLITHOS is a tool. The decisions you make with it are yours. The outcomes of those decisions are yours. The responsibility is yours.

IV. License Grant

4.1 Software License

Upon purchase, we grant you a limited, non-exclusive, non-transferable, revocable license to:

Install and use The Monolith System on devices you own or control
Access our backend services via your assigned API key
Use outputs generated by the Service for any lawful purpose

4.2 Restrictions

You may NOT:

Redistribute, resell, sublicense, or share the software
Share your API key with any third party
Reverse engineer, decompile, or disassemble the software
Use the Service to build a competing product
Use the Service for any unlawful purpose
Circumvent any access controls or usage limits
Automate access in a way that exceeds reasonable personal use

V. Subscriptions & In-App Purchases

5.1 Subscription Plans

MONOLITHOS offers tiered subscription plans that unlock varying levels of AI compute, module access, and generation quotas. Plan details, pricing, and feature comparisons are displayed within the application and on our website.

5.2 Payment Processing

Payments are processed by Stripe, Inc. (for desktop/web purchases) and Apple (for purchases made through the iOS App Store via In-App Purchase). We never see, store, or have access to your full payment credentials.

5.3 iOS In-App Purchases

Subscriptions purchased through the iOS App Store are governed by Apple's terms:

Payment is charged to your Apple ID account at confirmation of purchase.
Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of the selected plan.
You can manage and cancel subscriptions in your Apple ID Account Settings.
Any unused portion of a free trial period will be forfeited when you purchase a subscription.

5.4 Refunds

For Stripe-processed purchases, refund requests may be directed to [email protected]. For Apple In-App Purchases, refunds are handled exclusively by Apple through their Report a Problem portal.

VI. Fair Use Policy

6.1 Personal Use Definition

MONOLITHOS is licensed for personal use only. This means:

Use by you, the individual licensee
For your own thinking, research, creative work, and productivity
On devices under your direct control

6.2 Usage Limits

Each subscription tier includes a monthly allocation of Compute Points and module-specific quotas. Exceeding your allocation may result in throttled access until the next billing cycle. Details of your current plan's limits are visible in the application's Settings panel.

6.3 Prohibited Activities

Immediate termination without refund may result from:

Sharing or selling your API key
Automated scraping or bot access
Attempting to extract or reverse-engineer our AI infrastructure
Using the Service to generate spam, malware, or illegal content
Any activity that degrades service quality for other users

VII. Intellectual Property

Your notes, thoughts, and outputs belong to you.

We claim no ownership over:

Content in your Markdown vault
Outputs generated using our AI tools
Ideas, strategies, or decisions you develop

You retain full intellectual property rights to everything you create.

VIII. Disclaimers

8.1 "As-Is" Provision

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

We disclaim all warranties, including but not limited to:

MERCHANTABILITY
FITNESS FOR A PARTICULAR PURPOSE
NON-INFRINGEMENT
ACCURACY OR RELIABILITY OF OUTPUTS
UNINTERRUPTED OR ERROR-FREE OPERATION

8.2 AI Outputs

AI-generated content may contain:

Errors
Inaccuracies
Hallucinations
Outdated information

You are responsible for verifying any AI output before relying on it for important decisions.

IX. Limitation of Liability

9.1 Cap on Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MONOLITHOS LLC'S TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9.2 Exclusion of Consequential Damages

WE SHALL NOT BE LIABLE FOR ANY:

INDIRECT DAMAGES
INCIDENTAL DAMAGES
SPECIAL DAMAGES
CONSEQUENTIAL DAMAGES
PUNITIVE DAMAGES
LOSS OF PROFITS
LOSS OF DATA
LOSS OF BUSINESS OPPORTUNITIES

This applies even if we were advised of the possibility of such damages.

X. Indemnification

You agree to indemnify, defend, and hold harmless Monolithos LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

Your use of the Service
Your violation of these Terms
Your violation of any third-party rights
Content you process through the Service

XI. Account Termination

11.1 By You

You may terminate your account at any time by:

Canceling your subscription through the Platform or your Apple ID Account Settings (for iOS purchases)
Contacting [email protected] with a termination request

11.2 By Us

We may suspend or terminate your account:

With notice: For terms violations, after warning
Without notice: For severe abuse, fraud, or illegal activity

11.3 Effect of Termination

Upon termination:

Your API key will be deactivated
Access to backend services will cease
Your local vault and notes remain yours (we never had them)
No refunds for the current billing period

XII. Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

12.2 Jurisdiction

Any disputes shall be resolved exclusively in the state or federal courts located in Wilmington, Delaware.

12.3 Informal Resolution

Before filing any claim, you agree to contact us at [email protected] and attempt to resolve the dispute informally for at least 30 days.

XIII. Modifications

We may modify these Terms at any time. Changes will be:

Posted on our website with updated date
Communicated via email for material changes
Effective 30 days after posting (or immediately for changes required by law)

Continued use after changes constitutes acceptance.

XIV. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable.

XV. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Monolithos LLC regarding the Service.
